Terms & Conditions Agreement Signature

Terms and Conditions   


It is agreed between(Client) and Kalli Minger (Owner of flower wall and A&K Decor Rentals) that Owner hereby rents to Client, and Client hereby rents from Owner the following described Rentals situated in Cedar Rapids, IA. Rental, as referred to as the “Flower Wall” in consideration of the mutual promises of the parties herein, and the following terms provisions and considerations.


  1. TERM. The duration of this rental agreement shall be from the time of drop off in morning or afternoon for $300 paid beforehand in full, not including accessories and mileage, untill the time of specified pick up the day of. Client will inform Owner of these specified times before the drop off of the Flower wall. Client will provide a 50% down payment ($150) 2 weeks before delivery of rental and provide full payment 2 days before drop off of rental with no exceptions. 

  2. RENT. Client agrees to pay $300 per day payable without demand two days before rental drop off. Payment is considered late if not received 2 days before delivery of rental. A late payment will result in termination of the agreement between the two parties. The client will be verified by proper ID

  3. DEPOSIT. Client will provide a non refundable 50% deposit ($150) 2 weeks before delivery of rental and provide full payment 2 days before drop off of rental with no exceptions. Deposit provided secures your reservation for the anticipated date. Final balance due 2 days prior to event secures time, day, location of drop off and pickup for client

  4. DELIVERY CHARGE. Delivery is included within 15 miles of the offices of A&K Decor Rentals in Cedar Rapids, IA. Delivery outside that radius will incur an additional fee. Delivery exceeding 15 mile radius will conclude with a $0.50 charge for every mile added on for delivery. 

  5. RUSH FEE.  For bookings within 7 days of an event, a rush fee will be added. 5-7 days from the day of the event an additional 25% surcharge will be added to the invoice, 2-4 days 50% surcharge will be added, within 48 hours an 80% surcharge will be added to the total cost of the invoice. 

  6. DELAYS & DAMAGES: Any additional charges incurred by scheduling delays, or damages on behalf of the client (renter), their venue (location), or (guests) are due within 7 business days following the event. An invoice will be sent detailing any additional charges. Specialty requests and custom backdrops require additional terms. An invoice will be sent detailing any additional charges. 

  7. EVENT DETAILS: Event set-up and breakdown times will be confirmed 7 day(s) prior to the scheduled event. If details are changed or schedules are delayed for any reason by the client, contracting party, and/or venue within 7 day(s) of the scheduled event date, rental is subject to availability and there is a $30 charge for every 15 minute(s) delay to set up or pick up.

  8. Rescheduling is subject to availability and additional fees

  9. SET UP & BREAK DOWN TIMES: Flower wall takes at least (20 minutes) to set-up. This does not include unloading time and breakdown time. Additional time may be needed for custom requests and specialty items.

  10. Please allow ample time for venue access and schedule accordingly. 

Kalli Minger, the (A&K Decor Rentals company) and/or anyone acting on behalf of the company is not liable if unable to deliver to the contract or clients specifications due to scheduling delays caused by the client, contracting party, and/or venue's inability to provide minimum recommended allotted time for set-up and breakdown. Should set up be extended or delayed due to the elements (wind, rain, etc), unforeseen circumstances, or incorrect or misrepresented information by the client, contracting party and/or venue, Kalli Minger, the (A&K Decor Rentals company) and/or anyone acting on behalf of the company is not liable if unable to deliver to the contract or customer specifications. 


  1. OUTDOOR SET UP FEE: There is an additional fee for outdoor set-up's. Advanced notice is required by the client or venue. Advanced notice is required (7 days) before the event, with specified location provided.

  2. INCLEMENT WEATHER POLICY: Backdrops, accessory props, neon signs, materials and any services or products provided by Kalli Minger, the (A&K Decor Rentals company) and/or anyone acting on behalf of the company are for indoor and outdoor use, unless otherwise stated. They are not made for inclement weather. If outdoor use is preferred, equipment must be taken down and moved indoors or covered overnight. If bad weather or wind become an issue, Kalli Minger, the (A&K Decor Rentals company) and/or anyone acting on behalf of the company has ultimate authority to deny outdoor placement for safety reasons. Kalli Minger, the (A&K Decor Rentals company) AND/OR ANYONE ACTING ON BEHALF OF THE COMPANY IS NOT RESPONSIBLE SHOULD SERVICES NOT BE RENDERED DUE TO UNFAVORABLE CONDITIONS, UNFORESEEN CIRCUMSTANCES, INCORRECT OR MISREPRESENTED INFORMATION AND/OR PROPS BECOME UNUSABLE AFTER SET UP.

  3. PARKING: The client, venue, or contracting party is responsible for providing parking and providing reasonable accommodation to load and unload.

  4. INSURANCE & DAMAGE: Rental prices are inclusive of insurance for damage (or misplacement) of equipment or materials up to a certain value ($50). Excessive Damages or misplacement of valuable items will be billed to the contracting party at the market rate within 5 business day(s) of the event. Payment is required within 7 day(s) of receiving the invoice.
  5. CUSTOM & SPECIALTY REQUESTS: For custom props, backdrops, and specialty requests, a pre-agreed deposit will be required to cover materials, labor, recklessness, vandalism, neglect, or if an item is misplaced. If an item is misplaced, breaks or requires repair a fee for the market value will be billed to the contracting party at the market rate within 5 business day(s) of the event. Payment is required within 7 day(s) of receiving the invoice.

  6. CREATIVE PROP POLICY & PROP PLACEMENT: Kalli Minger, the (A&K Decor Rentals company) and/or anyone acting on behalf of the company has final approval on all prop & backdrop placement. Items need to be placed on even and flat surfaces. It is recommended that placement of flower wall is near a wall for stability & protection against the wind. Should set up be extended, canceled, or delayed due to the elements (wind, rain, etc), uneven ground, unforeseen circumstances, or incorrect or misrepresented information by the client, contracting party and/or venue no refund will be issued and Kalli Minger, the (A&K Decor Rentals company) and/or anyone acting on behalf of the company is not liable if unable to deliver to the customer or contract specifications. If additional time and/or resources are required for any of the reasons mentioned, services are subject to availability and/or additional fees; results are not guaranteed.

NEON SIGNS
  1.  NEON SIGN HAZARDS: neon signs can become hot or overheated if used for too long. Neon signs are hanging objects on the flower wall and may not by any circumstances be tugged on or hung on by clients and or guests at the event. Do not leave children unsupervised around the setup for their own safety. Flower walls can fall if tugged on hard enough.  Kalli Minger, the (A&K Decor Rentals company) and/or anyone acting on behalf of the company is not liable for any accidents of flower wall or props falling and hurting client or clients guests if tugged upon or moved without notice to Kalli Minger, the (A&K Decor Rentals company) and/or anyone acting on behalf of the company.

  2. SET UP & CLIENT CARE: Client is given permission to use any plugins already connected to flower walls for neon signs to turn on or off and understand risk of damage. 

MISCELLANEOUS
  1. FORCE MAJEURE: Kalli Minger, the (A&K Decor Rentals company) and/or any acting on the company's behalf shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.

  2. LIMITED LIABILITY: The Client, vendor and/or contracting company acknowledges and agrees that Kalli Minger, the (A&K Decor Rentals company) and/or anyone acting on behalf of the company not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the client has been advised or otherwise might have anticipated the possibility of such loss or damage.

  3. NO GUARANTEE: The client, venue, and/or contracting party acknowledges and agrees that and/or Kalli Minger, the (A&K Decor Rentals company)and/or anyone acting on behalf of the company cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Rather, services shall be executed in a professional manner and in accordance with good industry practice. Best efforts will be used but no results are promised.

    Client acknowledges receipt of a copy of the Terms and Conditions/Rental Agreement by signing below, acknowledges understanding and agreement of aforementioned information.
